According to Circular 23/2014/TT-BLDTBXH and Official Letter No. 4064, from January 1, 2015, all employees working under indefinite-term labor contracts or contracts from full 03 months must participate in social insurance, health insurance and unemployment insurance. This regulation is clearly stated in:
- Article 2 of the Law on Social Insurance (Law No. 71/2006/QH11)
- Article 43 of the Law on Employment (Law No. 38/2013/QH13)
- Clause 6, Article 1 of the Law amending and supplementing a number of articles of the Law on Health Insurance (Law No. 46/2014/QH13)

1. Registration of labor declaration:
- Business registration license.
- Labor declaration form.
2. Trade union registration:
- From 05 employees or more:
- Business registration license.
- The labor declaration form has been approved by the District UB.
- List of union members.
- 2x3 photos (2 photos).
- Less than 05 employees:
- An application confirming that the union is not eligible for establishment.
- The labor declaration form has been approved by the District UB.
3. Register for the salary scale system:
- More than 10 employees:
- Decision on establishment of trade union (issued by the Confederation of Labor).
- The labor declaration form has been approved by the District UB.
- Minutes of the meeting of the Trade Union Executive Committee on the agreement on the salary scale.
- Stipulating the standards for each position in the salary scale.
- Internal labor regulations, labor agreements, labor contracts.
- Less than 10 employees:
- An application confirming ineligibility for establishment of a trade union approved by the District Confederation of Labor.
- The labor declaration form has been approved by the District UB.
- Official letter agreeing on the salary scale.
- Stipulating the standards for each title in the scale
- Labor contract.
4. Registration of social insurance, health insurance and unemployment insurance:
- Business registration license.
- Registration form for participation in social insurance.
- List of applications for issuance of social insurance books and health insurance cards.
- Declaration of participation in social insurance.
- Payroll from the month of establishment (provided by the enterprise).
- Labor contract.
- The labor declaration form has been approved by the District UB.
- The salary scale system has been approved by the District UB.
- Social insurance book (if any).
- Other relevant papers.
