WHAT ARE THE LEGAL PROCEDURES FOR INHERITING VEHICLES?

According to the 2015 Civil Code and Circular No. 58/2020/TT-BCA on vehicle registration, the process includes:
Step 1: Notarization of the inheritance document
If there is a will: the heir prepares a declaration of inheritance.
If there is no will: the heirs must make a written agreement to divide the estate.
Step 2: Declaration and payment of taxes (if applicable)
Review personal income tax obligations.
Many cases involving inheritance between spouses or parents and children are exempt from tax.
Step 3: Register the ownership transfer at the vehicle registration authority
Required documents include:
Vehicle registration application form;
Notarized inheritance document;
Original vehicle registration certificate and license plate;
ID or personal documents of the heir;
Proof of inheritance relationship (if no will is available).
Step 4: Pay registration fee (ownership transfer fee)
The fee is calculated based on the value of the vehicle at the time of registration.
Scenario: Mr. T passes away and leaves a will naming his son A as the heir to his car.
A goes to a notary to declare the inheritance.
A pays the registration (ownership transfer) fee as required.
A submits the transfer dossier to the vehicle registration authority.
A receives a new vehicle registration certificate in his name.
Lack of valid documents (e.g., missing vehicle registration, no valid will).
Disputes among heirs regarding ownership.
